All references to The Client include the participant(s), or participant’s parent(s) or guardian(s).
All references to The Program include any combinations of the products distributed by Cognitive Learning Hub as per the website.

Please read these terms and conditions of use carefully before using this website or any programs provided by us. By using our website and products you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy and website disclaimer, govern Cognitive Learning Hub's relationship with you in relation to your use of this website and services. By using this website and any services or products provided by us, you signify your acceptance of these terms and conditions of use. For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to cognitivelearninghub.com.au and “You” and “Your” refers to you, the client, visitor, website user or person using our website or services.

Amendment of terms

We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and Cognitive Learning Hub's rights and obligations to each other.

Limitation of liability

It is an essential pre-condition to you using our website and services that you agree and accept that Cognitive Learning Hub is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Competition and consumer act

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Cognitive Learning Hub's liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again. You must be over 18 years of age to use this website and to purchase any goods or services.

Delivery of goods

Digital goods are delivered as soon as possible. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.

Training programs

  1. When you enrol in a program with us, you agree to participate in the program according to the recommended protocol (this varies depending on the program, and if you are unsure please contact us).
  2. For subscription-based programs, your subscription start date is as follows: Fast ForWord Cognitive, Fast ForWord Reading, Cogmed, Social Development, ClearFluency, Personalised Cognitive Training & Personalised Remote Learning: the first day you log in and use the program.
  3. Your subscription length is indicated on your receipt. Subscriptions cannot be paused and participation beyond this initial pre-paid subscription period will incur additional fees.
  4. The weekly, fortnightly or monthly personalised coaching call session of up to 15 minutes each will be scheduled in advance, at mutually suitable times. We will send you an email and/or SMS inviting you to book these calls. If you do not book a call, we will leave a message or send an email. It is your responsibility to respond should you wish to speak with us.
  5. If you are unavailable when your Education Learning Specialist calls you at your scheduled time a program progression email will be sent instead.
  6. The subscription is for continuous months usage and may not be paused during the subscription period, unless agreed by Cognitive Learning Hub and confirmed by email. The best benefits from the program come from consistency of use. Additionally, Cognitive Learning Hub incurs costs for any extension and hence there will be a cost passed to the Client for any agreed Pause that involves extending the end date.
  7. Additional monthly subscription usage is subject to advice from your Education Learning Specialist that the Client would be likely to benefit from more time on the Program and is subject to further payment (as agreed from time to time).
  8. For the best possible outcome the Client agrees to use the Program in accordance with the protocols advised by Cognitive Learning Hub. Additionally, for parent(s) or guardian(s) working with children, you are responsible for ensuring compliance and that all exercises presented each day are completed.
  9. While there is much scientifically based evidence for the effectiveness of the Programs, Cognitive Learning Hub does not warrant any particular outcome or result, as individual brains differ. Please see point 18 – Considerations that may impact the effectiveness of the Programs.
  10. Cognitive Learning Hub will provide technical support relating to the Programs, but will not be responsible for the compatibility or performance of the Client’s computer, Internet and communication technology.
  11. Cognitive Learning Hub handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
  12. In order for your pre-paid subscription to remain valid, training must commence within 2 months of purchase. All subscriptions will expire 12 months after purchase and training must be completed within this time.
  13. No refunds are available for change of mind enrolments. Should you wish to apply for a refund, please notify us in writing within 14 days of purchase with a valid reason for return. All refunds are made at the discretion of Cognitive Learning Hub.
  14. Cognitive Learning Hub will not make any refund of any part of the payment received for the Program - after the initial 14-day period - except if the Client is prevented from doing the exercises for an extended period due to a technical fault in the software of the Program.
  15. The amount of any refund will be at the sole discretion of Cognitive Learning Hub and an administration fee may be deducted.
  16. An alternative technology based educational program may be offered in lieu of a refund.
  17. The chosen package must be commenced within two months of purchase unless otherwise agreed by Cognitive Learning Hub (with email confirmation).
  18. Cognitive Learning Hub recommends that participants who experience epilepsy or depression/anxiety and other affective disorders seek medical advice before commencing any program with us as these conditions can be exacerbated by fatigue or visual stimuli.
  19. Considerations that may impact the effectiveness of the Program:
    • Internet connectivity and stability – The Client must have a reliable internet connection.
    • Ability to use a mouse or iPad – The Client must be capable of using the mouse or their iPad to interact with the Program
    • Autism – depending where The Client is on the spectrum, progress may be slow or limited
    • Cerebral Palsy – progress may be limited or slow due to physical restraints
    • Colour Blindness – Several exercises rely on colour differentiation
    • Developmental delay or intellectual impairment – progress may be limited or slow
    • Down Syndrome – progress may be limited or slow
    • Dyspraxia – the Program will not help with the motor planning of Dyspraxia but may be of use in addressing language development
    • Hearing impairment – some users with hearing impairment may need a FM loop as Fast ForWord requires The Client to be able to hear auditory stimuli
    • Sight impairment – the Program relies on viewing a computer screen.
  20. By using a program provided by us, you agree that any software or materials provided in connection with the training programs (the “licensed materials”) will be used only for the participant they were purchased for in connection with his/her authorised use of the training programs. You also agree not to copy, rent, lease, lend, license, sublicense, sell, export, assign, transfer or in any other way disseminate, reverse engineer, decompile, or create derivative works or adaptations from the licensed materials. While Sonic Learning provides computer technical support relating to the programs, they are not responsible for the compatibility, performance or efficiency of the participant’s device or Internet services. If you are unsure if your device is compatible with your training program please contact us for technical specifications.

Cognitive Learning Hub may from time to time provide on its website, links to other websites, advertisements and information on those websites for your convenience. This does not necessarily imply sponsorship, endorsement, or approval or arrangement between Cognitive Learning Hub and the owners of those websites. Cognitive Learning Hub takes no responsibility for any of the content found on the linked websites.

Cognitive Learning Hub's website may contain information or advertisements provided by third parties for which Cognitive Learning Hub accepts no responsibility whatsoever for any information or advice provided to you directly by third parties. At Cognitive Learning Hub, we are committed to protecting your privacy. We use the information we collect about you to maximize the services that we provide to you. You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure servers. Cognitive Learning Hub's secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorized use or access. Credit card information is not stored by us on our servers.

Third parties

We do not and will not sell or deal in personal or customer information. We may however use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and assist in meeting customer needs generally. In addition, we may use the information that you provide to improve our website and services but not for any other use.

Disclosure of information

Cognitive Learning Hub may be required, in certain circumstances, to disclose information in good faith and where Cognitive Learning Hub is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.

Exclusion of competitors

If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of Cognitive Learning Hub. Cognitive Learning Hub expressly excludes and does not permit you to use or access our website, to download any documents or information from its website or obtain any such documents or information through a third party. If you breach this term then Cognitive Learning Hub will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. Cognitive Learning Hub reserves the right to exclude and deny any person access to our website, services or information in our sole discretion.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. Whole agreement

Exclusion of unenforceable terms

Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

Education or life coaching

By using our services, you agree that Cognitive Learning Hub's is not to be held liable for any decisions you make based on any of our services or guidance and any consequences, as a result, are your own. Under no circumstances can you hold soniclearning.com.au liable for any actions you take nor can you hold us or any of our employees liable for any loss or costs incurred by you as a result of any guidance, advice, coaching, materials or techniques used or provided by Cognitive Learning Hub.

All our information on both the website and in consultations is intended to assist you and does not in any way, nor is it intended to substitute professional, financial or legal advice. Results are not guaranteed and soniclearning.com.au takes no responsibility for your actions, choices or decisions.

Jurisdiction

This agreement and this website are subject to the laws of Queensland and Australia. If there is a dispute between you and Cognitive Learning Hub that results in litigation then you must submit to the jurisdiction of the courts of Queensland.
